Procedural Safeguards

Background Information

As noted on the Minnesota Department of Education's website,

A copy of the procedural safeguards must be given to the parents of a child with a disability under the Individuals with Disabilities Education Act (IDEA) at least one time a school year. A copy must also be given to the parents:

1. Upon initial referral or parent request for evaluation.

2. Upon receipt of the first state complaint with the Minnesota Department of Education in a school year.

3. Upon receipt of the first due process complaint in a school year.

4. On the date the decision is made to change the placement of a child with a disability due to a violation of a code of student conduct.

5. Upon request by a parent.

If you have a student with an active Individualized Education Plan (IEP) or Individualized Family Service Plan (IFSP), these safeguards will be mailed to your home each fall.  If you have questions or concerns, please contact your student's case manager or the District Student Services Department at 763-600-5081.
